In general, if you have sex with a girl who is passed out, yeah it's rape. Clearly she could not consent.

However, a scenario like Crippler's is obviously possible and I wouldn't call that rape. But there we're talking about a married couple. If you're out in the world of one night stands and random hook ups, passed out chicks are off limits.

The idea of some women not caring about this struck me as odd, but then I thought about it. I imagine myself as a single dude fooling around with some random hottie. If I passed out before the deed was done and she was still able to have sex with me, I wouldn't freak out about it. Like Aunt Spiker said, I'd just regret that I wasn't awake to enjoy it! Honestly guys, how many of you, if you were already into the girl and wanted to have sex with her, would freak out if you found she had sex with you after you passed out (assuming that was physically possible). I don't think many men would have a problem with that. Again, assuming you knew the girl and were planning on going for it yourself.

Obviously consent was already given by both parties. That's a lot different from having sex with a woman who is passed out and can't consent in the first place.

OK, now turn that scenario around and put in place a girl who you'd never want to have sex with (like for instance some ugly fat chick since I'm assuming you're very shallow) and she has sex with you after you passed out. And after you came to, all your friends knew it. Would you still be OK with it? How would you feel if it got around that you slept with her? Who would believe you if you said it wasn't consensual? How would you feel if other women said you were asking for it by how you were dressed? What would you say to those who ask what you were doing at the party in the first place?

Consent is a door that - like a Bisexual person - swings both ways.

cammy would do well to remember that - if his meth-raped brain that never consented to that chemical assault has the capacity to do that any more - the next time he thinks of saying what he does in future. Be careful what you wish for, Mary Jane: the next one up for non-consenting sex may be you - and not necessarily the way you want it.

Hypothetically:

You're drinking with a girl. You are thinking about tapping that but you pass out somewhere around the time you fumble for her bra.

You wake up in the morning and your ass is sore, you have mild burns and welts, there is human shit everywhere and at some point a third party of unknown gender was "invited" into a threesome with you while you were incoherent and your only clue to their identity is the largest, sweatiest, most foul smelling pair of sweatpants you have ever seen which incidentally were used to tie you to the bed... face down

Does whether or not any of these things being your kinks that you never discussed beforehand affect you being okay with this happening?

Then it wouldn't be /rape/ would it? If a woman intended to have sex with a man, but passed out prior to the act being performed, then yes, she is unlikely to object.

To be clear, the above scenario is impossible to validate from the POV of someone other than the passed out person -- thus, it is very wise to "just say no" to sex with people who are passed out

However, the concern is when the woman *wasn't sure* if she wanted to have sex (or *definitely didn't want to have sex*) immediately prior to passing out. That's when rape occurs, after all.

So the scenario presented should be changed from "Again, assuming you knew the girl and were planning on going for it yourself." to "Assuming that you either ***didn't know the girl*** or ***didn't want to have sex with the girl***"". I think many men, if not most men, would be very unhappy to discover that they had sex in this scenario.
