Exodus 21:16 dictates the death penalty for kidnappers. Because every rape constitutes a kidnapping, under a biblical law, if convicted, this man should not be put in prison at innocent taxpayers' expense. He should be put to death expeditiously, per Ecclesiastes 8:11.

That the innocent (including this child's parents) are liable for the housing, clothing, feeding, and entertainment of society's criminals in an unbiblical penal system is but more evidence of the biblically seditious nature of America's Constitutional Republic. Time to get back to our true biblical foundations as evidenced in 17th-century Puritan America.

Under the Bible's juridical system prisons are superfluous. Convicted capital criminals are put to death expeditiously, per Ecclesiastes 8:11. Non-capital criminal are required to pay two to five times restitution (depending upon the nature of the crime) to their VICTIMS, per Exodus 22:1ff, etc. If a thief is unable to pay the required restitution, he's to be sold into indentured servitude until restitution has been paid, per Exodus 22:3. If he refuses to pay restitution, his contempt of court is a capital crime for which he's to be put to death expeditiously, per Deuteronomy 17:9-13.

Perfect, just like King David said it was in Psalm 19:7-11. Under such a system, crime would be all but unheard of and tax-paid-for prisons would non-existent.

Except our and even the US justice system (flawed as it is in my opinion, especially because of the inclusion of the death penalty, juries, privately owned prisons and judges which are voted into office) is based upon the idea of human rights, including fair punishment and following rehabilitation. What you suggest would be the death of fair trials and our society as we know it (I'll ignore for now that you basically want to reinstitute slavery, which makes this even more horrible). You know what human rights are (interestingly enough) based upon? Human dignity, a concept popularized by CHRISTIAN theologists and philosophers. You just want to get back to a society that's "easier" to grasp for you and which caters to your religious revenge fantasies. But if it were real you would probably be the first to be crushed by an unfair, populistic trial system.

@ ChrisBP747. Judges voted into office seems far preferable to the situation we have here in Australia. It seems to me that Judges in the US are somewhat accountable to public expectations when sentencing convicted people.

In Australia, Judges are appointed by politicians. These same politicians want to appear to the public that they have crime under control. They are always pointing out that prisoner numbers are steadily falling. Hence we see extremely soft sentencing or immediate release orders for people who the public would expect should spend significant time in jail.

Just last week here in Queensland we saw a male (I won't call him a man) laughing as he walked from Court a free man after he had been found guilty of doing nothing while watching his defacto wife beat her son to death.

She has yet to face Court, but given the 'justice' system I'm sure that being female she will get a significantly lesser incarceration time than if the roles were reversed.

Youth crime here is out of control. Kids steal cars and go on rampages around our streets. Innocent people have been killed by these ferals. How do they get away with it? Our brilliant politicians have decreed that the Police are forbidden to chase these young criminals. That's right, the kids drive up to the police stations and taunt the police. The cops have to take it on the chin. When on the rare occasion these kids are brought before the Courts, they are severely beaten with a feather duster and sent straight back into the community.

People voting Judges into office seems a very good idea to me.

US prisons are a form of indentured servitude. That's likely part of the reason both rehabilitation and crime prevention initiatives are often not prioritised - because an ounce of prevention costs a pound of unpaid labour.

OT laws were harsh not because the ancient Near East was the next thing to a paradise on earth but rather because it wasn't - and prisons would have been useless to the early Israelites who were, by necessity, pastoral nomads.

There is a lot else to add, here, but why bother? For people like Weiland, killing, death, and more KILLING is always among the first "solutions" offered as a panacea for every social ill (including ones that exist within his own head).

Look, I don't know about the australian judiciary, but just a few weeks ago Trump pardoned a judge who was voted in by explicitely telling his (southern) voters that he would target immigrants specifically and put them under inhuman circumstances in his prison(s?). He did this for a very long time before he was finally convicted for misconduct (only to be pardoned... sigh). And he's not the only one. People vote in all kinds of idiots, that's how we got the orange menace into the white house after all. People also tend to favor revenge over rationality. When a horrible crime happens they are often out for blood and when someone is found who could be the criminal they often don't listen to reason anymore, caring more for the punishment than finding out whether he or she actually did commit this crime. I'm very glad that's not how it works here in Germany. Our judges apply for the job, undergo investigation by the justice department and are inducted to be civil servants. They are free in their decision making as long as it keeps in line with state law. And they work under the principle "innocent until proven guilty". Is that a perfect system? No, as the son of a lawyer I've met both quite a few hillariously incompetent and frighteningly intelligent judges in my life at the same time. But at least they usually don't have a political agenda.
Look at the southern states of the US, where even small drug crimes are punished hard, partly because the voters want it that way, partly because it helps the privatized prison system. Are they more secure than Germany, a country with relatively low crime rates in general? I seriously doubt it. I feel more secure in a state that believes in "in dubio pro reo" than in a state where every accused is treated like a criminal in court, as long as he doesn't have enough money for a good lawyer. But perhabs that's just me.
