Good question Cameron. By reading the posts here, I would guess if that kidnapper is on US soil they have every right afforded them under the Constitution because we are a nation of Laws and Values. Torture is torture, whether it's done by our government or even by us in order to save our children's lives. If we let a child's life take precedence over these strict moral values, we start becoming more and more like our enemy.
