You do not prove that Christian Identity is a legit religion, like Islam
So who is it that decides what makes a religion legitimate or illegitimate? What criteria is used to make that determination?

Not only is it not illegal, but it would be an outright of both the letter and the spirit of the 1st Ammendment. What part of "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." escapes such a learned legal scholar as yourself?
Islam has been granted protection under the Constitution --- ILLEGALLY.
Islam hasn't been "granted" constitutional protection, nor has christianity, judaism, taoism, or even scientology. The US constitution does not empower the government to allow or disallow constitutional protection for any religion, it grants the people the freedom to worship whatever religion they choose to and forbids the government from preventing the people from prohibiting that freedom (i.e. making a particular religion illegal.).
A religion cannot be "illegally" granted constitutional protection because freedom of religion is granted to the people, not the religious institution and under constitutional law, a subject you are obviously know next to nothing about, that freedom cannot be denied or abridged by anything short of a constitutional ammendment.
