In a bench conference during Louisville Metro Councilwoman Barbara Shanklin’s fiery misconduct trial, her lawyer said the prosecutor couldn’t be trusted to tell the truth because he “does not believe in God” or in “heaven or hell.”

“What guides him morally?” defense lawyer Aubrey William, who is an ordained minister, asked about attorney David Tachau. “What compels him to tell the truth?

“He will say anything,” Williams said, according to a transcript of the bench conference Wednesday before Council Court Chairman Jim King that was obtained by The Courier-Journal.

Defendant/respondent has the right to a record/transcript of all civil and criminal trial proceedings --including bench conferences. Sidebars aren't confidential. The jury is not allowed to hear them. It doesn't matter if anyone else hears/reads the transcript of bench conferences.

Every one of these comments is exactly why the jury should not hear bench conferences. And precisely why they didn't hear this one.

The late Council Court Chairman Jim King was a lifelong, active member of the Catholic Church. It was within King's judicial discretion to consider the prosecutor's personal character in considering dismissing the case as malicious prosecution --and Williams' duty to his client to challenge the prosecutor's motive. Just as courts make discretionary assumptions that an occupation in law enforcement equals "honest" so might any religious judicial officer make the discretionary assumption that religious belief is a reasonable estimate of honesty.
