This is like someone 50 years ago saying, "Black people are already equal with white people under the law. They have their own schools, restaurants, water fountains, etc. And a black man can marry a member of his own race, just as a white person can marry a member of his own race. I don't know about Dalicious, but I married a person I love and am attracted to. I didn't marry just any man, on the sole basis that he was a man. I fell in love with a person, not a gender. I fell in love with his personality, his humor, his taste in music and films. Sure, he has nice legs and is tall in stature, but those are not unique male things.

Take two adult couples. The members of both couples are in love, they are capable of making their own legal decisions and they want to get married. Couple A, which consists of a man and a woman is granted a marriage license. Couple B, which consists of two adults of the same gender is refused.
Clearly the members of couple A have a right that couple B does not. Therefore, couple A and couple B are NOT equal under the law. So, yes, there is very much a legal problem to be solved.
And your side has yet to offer a legally sound reason to support its case.
The problem with that argument that I always like to point out is now that same-sex marriage is legal, everyone is just as "equal under the law" as they were before. Men can marry men and women can marry women, regardless of their sexual orientation. Where's any inequality?
