As far as I know, most people misrepresent themselves on dating sites, at least as far as their age, weight, and physical condition is concerned. But apart from that, dating sites aren't part of public administration. No one has to swear an oath. You can say anythng you want about youself. You don't have to sued for any rights. But why would you? You won't be getting the results you want. It's just nonsense.

For a transgender person, it is to misrepresent him/her/itself or themselves to use the assigned-at-birth-gender.
