Historically, the most common definition of "sodomy" is "any sexual activities of which the speaker disapproves". At times, penile-vaginal intercourse in the wrong position could be labeled (and prosecuted as) "sodomy".

In what world does something remain a crime after it is legally no longer a crime, regardless of whether those law-makers involved are seen as meany-beany-fo-feenies by reactionary fuckwits on the internet? There is no objective reason for it to be viewed as criminal due to the logic of other laws, the laws making it specifically illegal are gone, so in what respect can you claim it still to be a crime? It's not that the penalties were, as you put it "removed" or not enforced, it's that the laws make homosexuality a crime have been repealed, they no longer exist at all. It's not like the adultery laws which, where they even still exist, go un-enforced and un-prosecited, it's like Prohibition, where the laws were repealed and no longer exist.
If you're going to feel sorry for someone about anything, at least feel sorry for something worthy of pity, like financial problems or a medical condition. Being homosexual isn't anything to feel sorry for, no more than heterosexuality is.
