Also, I have been saying this for awhile.....The “Supreme” Court does not make laws, it simply offers opinions on whether or not a “law” meets Constitutional muster. If the law violates the Constitution, then the law is remanded back to the Legislative branch so that the law can be re-written to fall in line with the Constitution. This is how our government is supposed to create laws.
Bear in mind that offering an “opinion” does not change the law. They just tell us that it does and we believe their lies. We then repeat their lies and teach them to others. The lies soon become “truth”, although it is not The Truth. I’ll say it again. Courts do not make laws.
Only the legislative branch (congress) can make or change laws. NOT the SCOTUS.

I'm just going to copy-and-paste my response to an earlier post of this sort:
1) Judges do, can and always have made law. By interpreting existing law, they make new law. The idea that they don't is a polite fiction. The fact is that the majority of law is precedent, case law. This is exactly how our system of laws is meant to work.
2) There is nothing in the constitution that says "the SCOTUS cannot make judgements about X or Y". That's what they did and what the constitution intended them to do.
3) Your second paragraph is just a completely fictional account of how the law is supposed to work.
4) You are, in essence, simply bitching about judges making a decision you dislike. In which case: buck up and take a number. I'm still pissed about Citizen's United .

There are words, afchief, that mean one thing in everyday language but something else in the language of a particular profession. For example, a "devil" is a demon to most people, but to a printer it's an apprentice. Likewise, to a lawyer "opinion" does not mean a point of view, but a legally-binding ruling. You may be interested that there are other such legal terms like "sentence," "reasonable" and "legitimate" that might you want to find out about; it will help next time you're in court.
You may also be interested to know that Article 3, Section 2, Clause 1 of the Constitution means that courts are forbidden to issue advisory opinions - see Muskrat v. United States.

As usual, no argument on why the SCotUs created a new law. They simply compared the deferred law with the Constitution of the USA.
DOMA was making a new law. DOMA was attempting to assert a new, more restrictive definition of marriage. The Supreme Court compared it to the Constitution and found it in violation of the rights it assures and are deemed inalienable and shot it down.

I'll try to explain in small, simple words.
1. The Constitution is the BIG law.
2. It's bigger than any other law and provides citizens protections.
3. State laws CANNOT violate protections given to citizens by the Constitution.
4. The SCOTUS decides if state laws violates protections given to citizens by the Constitution.
5. If the SCOTUS decides a state law violates protections given to citizens by the Constitution then that law is no longer a law.

Um, yes it does you moron. That's the job of the Supreme Court, to determine the constitutionality of laws. That's why it's the third branch of government and an essential part of the balance of power, so Congress and state legislatures can't pass a bunch of unconstitutional laws. If the SCOTUS can't strike down bad laws, what good are they?

Practicing homosexual lifestyle is like practicing heterosexual lifestyle, only with a different set of genders.
The Supreme Court are the ultimate interpreters of Federal law in the US. It's not an opinion, it's a Constitutional decree.
Laws forbidding some consenting couples to marry while other couples are allowed, were deemed unconstitutional. That is all that happened.
It was the Founding Fathers who started these "lies"; blame them!
