That's the problem with this one. He's not proposing a law, he's proposing an Amendment. If such an amendment were ratified, then those laws that are being struck down as unconstitutional would no longer be unconstitutional. Judges rule on laws, not amendments.

I understand that point, but seeing as how the high courts deal with moral issues and not religious pressure, the chances of such an amendment getting passed would be darn near impossible.

Not that, if 2/3 of Congress somehow voted for a ban on homosexuality, it wouldn't be an unmitigated disaster. (As others point out, an amendment trumps Supreme Court rulings, e.g. the 16th.) Most likely a decade or more of unjust imprisonment, random violence, needless deaths, and social upheaval would ensue. The only winners would be criminal organizations that use "gay clubs" to finance their other enterprises. Then Congress would amend the constitution AGAIN to nullify that amendment, simply to make the chaos stop.
But at least Jim's probably nonexistent god would be happy. It LOVES blood sacrifices.
