Science says life began something like 4 or 5 billion years ago. We are just a continuation of that. The egg was alive before the living sperm fertilized it.
The question of what value we place on the lives of human embryos and fetuses and when we give a human life personhood isn't really a matter of science. Nobody on either side really gets to say "science says we should do things my way" because it's a moral argument, not a scientific one.

The right to abortion is based on the 9th and 14th amendments. The Constitution doesn’t have to spell out every instance of your rights.
Viability does matter otherwise we would be persecuting people for miscarriages which affect 25% of all pregnancies and possibly all non viable pregnancies. There are millions of ways a pregnancy can go wrong and we’ve long moved past “blame the woman” as a way to explain it.
