Are we talking interrupting a rape in progress, immediately upon the discovery, or premeditated in cold blood? Because there's a difference legally speaking. Morally - and I can only speak for myself - the first is justifiable assuming the attacker didn't surrender themselves immediately as that would just be an execution, the second (and I'm including the exception noted for the first situation) is arguable as temporary insanity, the third though I sympathize is simply not acceptable and the greater principle of the law must be upheld or else we lend legitimacy to vigilantism or worse, lynch mobs.
I can understand WANTING to beat someone to a pulp, at first hearing your sister, wife or daughter (or, for that matter, your brother, husband or son) has been raped. But to plan a beating, seeking out the person, perhaps bringing “equipment”, that’s premeditated.
There’s also a difference if you hit someone once and they fall so bad or you hit the wrong spot and they die, or if you keep on beating long after the person has fallen down or even become unconscious. The latter is complete disregard whether the person lives or dies.
Hate the OP all you like, but that an act should be viewed as it is purely in itself is a defensible position within ethics which we call deontological ethics of which Immanuel Kant was the primary exponent. Kant himself even explicitly stated that even when a murderer comes to you to ask where the person is that he wants to kill that you're not allowed to lie. Sure, you're complicit in the murder if you don't, but you're not allowed to lie and the fact that you're not allowed to lie takes priority over anything. Besides, within Kantian ethics there's a difference between the act of killing and the act of giving someone the information they need in order for them to kill. Kant would say that while the former is never acceptable, the latter act is acceptable if only because lying is Always bad.
Keep in mind that Kant still would agree that it is good, if not better, to not to give the information at all. He just assumed a situation where only lying and telling the truth are the only options.
This site is indeed called "fundies say the darndest things" for a reason, but as far as I know of we've never quoted someone who was such a diehard fan of Kant as to believe that he's an authority on literally everything.

No, 'involuntary' is still the key word. We have so many different ways to say someone killed someone. Whether they thought about it and took steps to avoid prosecution, or whether they reacted in a blind rage, two drastically different conditions, two very different threats to society.
There isn't a jury on the planet who would convict him.

As for the Dad, he should NOT spend a day in prison, but should receive a medal and be nominated for Father of the Year. You however, by defending a pedophile, a CHILD RAPIST no less, make me wonder about you? I’m sure the boys inside would be very impressed, if my suspicions turn out to be true.
Well now that context has been made properly evident I say with confidence daddy deserves a medal. There's even a mention in the article @Perturabo provided that during the 911 call as he was trying to direct emergency services to his home he displayed some actual concern for Jesus Flores' life as there was a significant delay so even in the face of every parent's worst fear he retained an admirable spark of restraint and human compassion. This man would not be paying for his drinks if we met at the bar and I hope he gives his daughter every hug and all of the support she will need to overcome this trauma and live strong.
The OP can have a piss-warm cup of shut the fuck up. Living beings have a right to defend their lives and to intervene to preserve the lives of others. This man even made getting the rapist medical attention a priority once he was subdued. There is no compelling grounds for complaint.

In which case, Immanuel Kant was also a complete fucking moron, as he thought he was demonstrating valuable ethics with an impossible scenario. Impossible because there’s no such thing as a binary choice. Anyone who can think in that situation that there is only Tell a Lie or Tell the Truth, without seeing there are shades of truth, truthful lies, shutting the fuck up, and even going to authorities to report an attempted assassination. Anyone who can only think to Kant’s leven, which Yin-serpent sounds like, does not have any place moralizing to others. Every time one takes part in absolute moralism, they always end up doing things far worse than they claimed it was before they finally brought morals.
