For context, some members of…I don’t quite remember which body…released an ad reminding active military members that, by law , they are required to disobey unlawful orders. It’s one of the first things they drill into your head in basic training. Because ‘just following orders’ wasn’t a defense in the 1930’s, and it’s not a defense now.
And Lindsay Graham had the vapours over the very notion, and of course Benedict Donald had opinions.

weeeeeeeeeeell…. Nuremburg only really established that leaders can’t use ‘following orders’ as a defense. Judges, high-ranking officers, etc. The courts there did not want to start letting every fucking private think he had a right to tell his officer to fuck off. So it kinda WAS a defense, to a certain level of impotence.
But then we had a few attention catching incidents in Viet Nam. And yes, Basic was 45 years ago and I can still see the room where they showed that presentation to us to encourage us to evaluate each order for merit.
There was the Amnesty room, giving up anything in our pockets we didn’t want to become evidence at our discharge, there was the urinalysis, there was the haircut, and then before we even had uniforms, DO NOT DO THIS DUMB-ASS SHIT!

It isn’t sedition to refuse to obey unlawful orders, as said in Little v. Barreme (1804).
And once again, Trump is so self-centered and narcisstic that slighting him is a capital offense in his opinion.
